Scope of Personal Shopping Services

1. Scope of Personal Shopping Services
Cheri’s Reclaimed Luxe offers personal shopping and sourcing services for pre-owned and luxury goods (“Personal Shopping Services”). These services involve researching, locating, and recommending items based on client-provided preferences, budgets, and availability at the time of sourcing.
Personal Shopping Services may include:
-Custom sourcing requests
-Approved finds located on the client’s behalf
-Time-based research and availability monitoring
2. Client Budgets & Pricing
Clients may provide a maximum budget for sourcing requests. This budget represents the upper limit that the client authorizes Cheri’s Reclaimed Luxe to search within.
If an item is found below the stated budget:
-The client will be charged the final purchase price only.
-Any remaining difference between the budget and purchase price remains with the client.
-The service fee remains unchanged unless otherwise stated in writing.
-If an item is found above the pre-approved budget:
Cheri’s Reclaimed Luxe will not purchase the item without prior written client approval.
-Clients must approve any over-budget purchase before payment is completed.
-If approval is given, the client agrees to pay the adjusted price in full.
Cheri’s Reclaimed Luxe does not assume responsibility for market price fluctuations, availability changes, or competitive purchasing activity.
3. Payment Terms
-Payment may be required in advance for sourced items or services.
-A sourcing or service fee, if applicable, compensates time, expertise, and research and is non-refundable once sourcing begins.
-Full payment is required before any item is purchased or shipped, unless otherwise agreed in writing.
4. Approval of Sourced Items
Clients are responsible for reviewing and approving:
-Item details
-Condition
-Pricing
-Seller disclosures
-Approval constitutes acceptance of the item as-is.
-Once approval is given and a purchase is completed, the transaction is considered final.
5. Condition, Authenticity & Disclosure
-All sourced items are pre-owned or resale unless explicitly stated otherwise.
Cheri’s Reclaimed Luxe makes reasonable efforts to verify authenticity using industry-standard methods.
-Authentication reflects a professional opinion and does not constitute a manufacturer's guarantee.
-Items may show signs of wear consistent with pre-owned luxury goods.
6. Returns, Refunds & Cancellations
-Due to the nature of personal sourcing and luxury resale:
-All personal shopping and sourced item sales are final.
Refunds or cancellations are not permitted for reasons including, but not limited to:
-Change of mind
-Fit or wear expectations
-Buyer’s remorse
-Price comparisons after purchase
-Exception — Shipping Damage:
-A refund or resolution may be considered only if:
-The item arrives severely damaged due to shipping, AND
-The damage is reported within 24 hours of delivery, AND
-Clear photos of the damage and original packaging are provided
-Approval of any refund or resolution is at the sole discretion of Cheri’s Reclaimed Luxe.
7. Market Availability & Liability
Luxury resale markets are dynamic. Cheri’s Reclaimed Luxe is not responsible for:
-Items becoming unavailable before purchase
-Price increases or bidding competition
-Seller cancellations or platform-level disputes
-Cheri’s Reclaimed Luxe is not liable for indirect, incidental, or consequential damages related to sourcing efforts or purchase outcomes.
8. Client Cooperation & Communication
Clients agree to:
-Provide accurate preferences and budget information
-Respond promptly to approval requests when necessary
-Communicate clearly regarding expectations
-Delays in response may result in missed purchasing opportunities.
9. Governing Law
This policy shall be governed by and construed in accordance with the laws of the State of New York. Any disputes shall be resolved in the state or federal courts located in Erie County, New York.
